Pakatan taking a huge gamble

Pakatan Rakyat is ready to lay its cards on the table by forcing a by-election in the Pelabuhan Klang state seat in Selangor. With the pre-2008 era of political arrogance a thing of the past, Pakatan will need to fight a tough battle for the seat.
THE Pakatan Rakyat, on the defensive after a spate of by-election losses since early last year, is taking a calculated risk by declaring vacant the Pelabuhan Klang state seat.
It wishes to force a by-election and hopefully secure a win; and with it erase the losing streak it has suffered ahead of an anticipated early general election.
Selangor is where the big polls battle will be hard fought.
A victory here will be a major moral booster for the hard pressed coalition. But, a defeat so close to home will be a major disaster.
Although the legality of the vacancy, declared by Speaker and DAP Selangor vice-chairman Datuk Teng Chang Khim on Thursday is disputed and the whole issue is likely to end up in court before even a by-election date is announced, the risks are worth it for the Pakatan Rakyat.
By most counts, the Pakatan Rakyat is heading for a defeat in the Jan 30 Tenang by-election in Johor and, unexpectedly, another by-election is to be held in Merlimau, Malacca with the death on Thursday of Barisan Nasional incumbent Mohamad Hidhir Abu Hassan, 54.
Merlimau is also a uphill matter for the Pakatan Rakyat as it is a Barisan Nasional stronghold.
But in the case of Pelabuhan Klang, Pakatan Rakyat – which could have excused incumbent Badrul Hisham Abdullah – has chosen to force the issue and possibly recoup the political momentum it once enjoyed with a convincing victory.
Teng, who made a public announcement of the vacancy, could have resolved the issue amicably by accepting Badrul Hisham’s application for leave.
Instead, he rejected the application as invalid and additionally disputed whether Badrul Hisham, who won the seat on a PKR ticket but defected to Barisan Nasional in 2009, should have applied before or during the Nov 8 -15 sitting last year.
Badrul Hisham also claims he attended the Nov 8 sitting, but this was denied by Teng who said his attendance is not recorded.
Badrul Hisham insists he is a victim of malice on the part of the Speaker for sitting on his leave application.
Legal experts say the relationship between an elected assemblyman and the Speaker is a special one, and not similar to that of an employee and employer.
“The Speaker exceeded his authority by evaluating the leave application and rejecting it,” one lawyer said.
However, another said Teng has the authority to weigh the application on its merits.
Whatever the case, Teng has taken the unprecedented step to vacate the seat leaving the Election Commission to grapple with the issue, and decide whether a vacancy exists and, if so, call for a by-election, the 15th or 16th as the case may be.
Legal experts say there is enough disagreements between the two political coalitions for the issue to end up in the court either for an injunction or a declaration on the matter.
The first test of Badrul Hisham’s status would be on Monday when he arrives to attend the special sitting of the state assembly.
The assembly is convened to amend the state constitution to give the state and the Palace the authority to select and appoint three top State officers – the state secretary, state legal adviser and state finance officer.
The move was sparked by the appointment of Datuk Mohd Khusrin Munawi as state secretary on Dec 6, which was consented to by the Palace but opposed by the state government.
When Badrul Hisham arrives to attend the special sitting along with other Barisan Nasional state assemblymen, Teng will be forced ask the clerk of the house to remove him, assuming that the Election Commission agrees to the vacancy between now and Monday.
If it does not, Teng would be put in a spot over whether to accept or reject Badrul Hisham after announcing the vacancy at a press conference without first officially informing the commission.
This situation gives rise to more action seeking redress in a court making the possibility of a quick by-election rather remote.
The Selangor Umno has also vowed to defend Badrul Hisham, an Umno member now, by taking the matter to court.
The Pakatan Rakyat must have thought over the Badrul Hisham issue extensively before vacating his seat especially given the fact that PKR had won the seat with a 4,407 vote majority in March 2008.
It sees a chance of repeating the feat if a by-election is called.
That 2008 victory was made possible by the sheer unpopularity of the former incumbent, the late Datuk Zakaria Mohd Derus who was caught in a huge scandal over a palatial mansion and other matters, including operating a satay stall illegally.
He was dropped in 2008 in favour of newcomer, his daughter-in-law, Roselinda Jamil.
Although Zakaria won the seat by a 7,237 vote majority in 2004, the scandals took away all the gains leaving Umno in negative territory by over 4,400 votes in the seat where 57% of voters are Malays; 25% Chinese and the rest Indians.
It will be a feat for the Pakatan to repeat that kind of victory in Pelabuhan Klang or elsewhere because the political arrogance and the Zakaria-type scandals that epitomised the pre-2008 era, are long gone.
Pakatan Rakyat’s desperation for a convincing victory before the big polls battle is understandable but with the political landscape constantly changing, such easy victories are hard to come by.
Anwar wajar debat dengan Saiful Bukhari terlebih dulu
KUALA LUMPUR 22 Jan. - Penasihat Parti Keadilan Rakyat (PKR), Datuk Seri Anwar Ibrahim dinasihatkan berhenti mencabar Perdana Menteri, Datuk Seri Najib Tun Razak untuk berdebat sebaliknya menyelesaikan masalah peribadinya terlebih dahulu.
Ahli Parlimen Kulim-Bandar Baharu, Zulkifli Noordin berkata, Anwar sepatutnya berdebat dengan Mohamad Saiful Bukhari Azlan berhubung kes liwat yang sedang dihadapi beliau dan bukannya menangguh, mengelak dan melengah-lengahkan perbicaraan.
Pada masa sama, katanya, Anwar juga sepatutnya berdebat dengan Ahli Parlimen Padang Serai, N. Gobalakrishnan yang mencabarnya melalui Twitter atau dengan peguamnya Karpal Singh yang sebelum ini mendedahkan mengenai salah laku homoseks dan liwat beliau.
Malah, Anwar juga perlu mencabar bekas Perdana Menteri Singapura, Lee Kuan Yew atau Bahagian Risikan Singapura dan Australia yang mendedahkan mempunyai 'bukti teknikal' dan percaya beliau terlibat dengan kegiatan homoseks dan liwat.
''Cuba berdebat dengan Karpal Singh kenapa mahu membela beliau sedangkan Karpal Singh yang mendedahkan mengenai salah laku seks Anwar di Parlimen pada 22 Oktober 1997.
''Beliau juga yang membongkar kegiatan homoseks dan liwat Anwar di Federal Hotel kepada kepimpinan Pas ketika itu dan mendesak Anwar bertaubat dan berundur apabila pembohongan 16 September terbongkar.
''Sekarang Karpal Singh pula yang menjadi peguam beliau. Tidakkah itu seperti putar dan pusing namanya? Pada saya, elok Anwar berdebat dengan Karpal Singh dahulu sebelum mahu berdebat dengan orang lain," katanya.
Beliau berkata demikian dalam entri terbarunya bertajuk Debat al-Musibat yang disiarkan menerusi laman blognya di http://zul4kulim.blogspot.com, semalam.
Zulkifli dalam entri yang sama juga menjelaskan, Najib tidak perlu menjawab cabaran debat Anwar itu kerana ia hanya membuang masa kerana bukan mahu membincangkan mengenai masalah rakyat.
Sebaliknya tambah beliau, Anwar menerusi cabaran debat itu hanya mahu berjumpa empat mata dengan Najib dan meminta supaya kes pertuduhan liwat Saiful Bukhari ditarik balik.
''Saya masih ingat Anwar beberapa kali meminta saya mengatur pertemuan dengan Najib untuk meminta ditarik balik kes pertuduhan liwat Saiful Bukhari.
''Walhal ketika itu saya masih Ahli Parlimen PKR. Saya pun tidak berminat dan tidak pernah pun berjumpa dengan Perdana Menteri mengenai isu itu.
''Tetapi mengapa dan apa sebabnya Anwar begitu takut sehingga mahu berjumpa empat mata dengan Perdana Menteri?," katanya.
Zulkifli menambah, Anwar sebenarnya takut dipenjarakan semula kerana beliau tahu tidak akan menang (sangkut) dalam kes Saiful Bukhari.
Anwar juga katanya, sedar sekiranya dipenjarakan, beliau akan menghabiskan usianya di dalam penjara sekiranya dijatuhkan hukuman 12 tahun penjara.
''Pada usia mahu memasuki 64 tahun, saya faham ketakutan Anwar itu. Apatah lagi dengan cucu yang menunggu di rumah.
''Saya tidak salahkan Anwar jika berasa takut masuk penjara. Cuma nasihat saya, bertaubatlah dan mohon keampunan daripada Allah SWT dan pohonlah supaya diberi jalan keluar yang makruf dan baik.
''Hentikanlah segala sandiwara dan pembohongan ini. Kembalilah ke jalan Allah SWT, bertaubatlah Anwar," katanya.
Pas 'rampas' kad pengenalan warga tua
LABIS 22 Jan. - Belum pun 12 jam kempen Pilihan Raya Kecil Dewan Undangan Negeri (DUN) Tenang bermula, Pas sudah mula panas punggung dan dengan sokongan yang diterima Barisan Nasional (BN) sehingga memaksa mereka menggunakan taktik kotor iaitu 'merampas' kad pengenalan warga tua.
Naib Presiden UMNO, Datuk Seri Dr. Ahmad Zahid Hamidi ketika mendedahkan perkara tersebut berkata, taktik 'merampas' kad pengenalan warga tua kononnya bagi memudahkan operasi menyalurkan bantuan sebenarnya bertujuan, untuk menghalang golongan tersebut daripada mengundi.
Katanya lagi, perkara itu berjaya dikesan hari ini selepas jentera pilihan raya pembangkang datang mengunjungi rumah ke rumah di Kampung Paya Merah dan mengambil kesempatan daripada kunjungan itu dengan menjanjikan bantuan pada 31 januari nanti tetapi penerima perlu menyerahkan kad pengenalan.
"Berdasarkan laporan yang diterima, mereka menjanjikan bantuan kepada warga tua yang uzur sehari selepas pengundian nanti dan bagi melayakkan golongan tersebut mendapat bantuan, kad pengenalan mereka perlu disimpan oleh jentera berkenaan sehingga 31 Januari.
"Ini adalah satu perbuatan jenayah jika benar ia dilakukan oleh jentera pembangkang kerana adalah menjadi kesalahan bagi sesiapa sahaja menyimpan kad pengenalan orang lain apatah lagi bagi tujuan menipu," katanya semasa berucap dalam majlis bersama rakyat di Kampung Tenang, di sini malam ini.
Hadir sama calon BN, Mohd. Azahar Ibrahim dan bekas Naib Canselor Universiti Teknologi Mara (UiTM) Tan Sri Ibrahim Abu Shah.
Ahmad Zahid sehubungan itu mahu semua penduduk di kawasan DUN Tenang berhati-hati dengan taktik jahat tersebut dan menasihatkan mereka supaya jangan mudah tertipu kerana tegasnya hanya Jabatan kebajikan Masyarakat (JKM) sahaja yang diiktiraf oleh kerajaan untuk menyalurkan bantuan.
"Apa yang jajahnya, kalau UMNO dituduh menjajah Johor, kenapa mereka tidak lemparkan tuduhan yang sama kepada Pas di Kelantan. Inilah kenyataan paling dangkal sedangkan Malaysia negara kita, UMNO bukan parti penjajah tetapi parti yang membantu rakyat untuk mengecapi kemajuan dan kesejahteraan," katanya.
Proses penamaan DUN terbaik
LABIS 22 Jan. - Proses penamaan calon Pilihan Raya Kecil Dewan Undangan Negeri (DUN) Tenang di sini pagi ini, adalah yang paling tenang setakat ini apabila berlangsung tanpa sebarang kekecohan dan insiden pergaduhan.
Suasana di atas jalan berhadapan pejabat Majlis Daerah Labis, yang menempatkan para penyokong kedua-dua parti yang bertanding iaitu Barisan Nasional (BN) dan Pas, terkawal tanpa sebarang provokasi mana-mana pihak.
Kira-kira 15,000 penyokong BN dan 8,000 penyokong Pas berkumpul sejak pukul 7.30 pagi di kawasan yang telah ditetapkan oleh Suruhanjaya Pilihan Raya (SPR).
Kehadiran kira-kira 4,000 anggota polis serta Rela berjaya mengawal ketenteraman di pusat penamaan calon itu.
Mengulas mengenai perkembangan itu, Pengerusi SPR, Tan Sri Abdul Aziz Mohd. Yusof memberitahu Mingguan Malaysia, suasana di Tenang jauh lebih baik berbanding pilihan raya kecil lain sebelum ini.
Sementara itu, Ketua Polis Negara, Tan Sri Ismail Omar berpuas hati dengan kawalan keselamatan yang dilaksanakan oleh polis Johor sepanjang proses pencalonan PRK DUN Tenang, hari ini.
28 laporan kempen politik diterima
LABIS – Polis menerima 28 laporan sejak 1 Januari lalu daripada masyarakat tempatan berhubung kempen parti politik yang dilakukan tanpa permit sah walaupun tempoh berkempen belum dibenarkan.
Jurucakap Polis, Superintendan Abdul Aziz Ahmad berkata, pihaknya telah membuka 14 kertas siasatan yang menjurus kepada aktiviti berkempen.
“Siasatan termasuklah mereka yang melakukan majlis tanpa permit dan kerosakan harta benda," katanya pada sidang media di Matrex Polis, di sini, semalam.
Selain itu, Abdul Aziz berkata, perubahan lalu lintas turut dilakukan sempena hari penamaan calon di Dewan Undangan Negeri (DUN) Tenang, hari ini.
“Mulai jam 12 tengah malam ini (tadi) sehingga selesai penamaan calon, kenderaan berat yang datang dari luar daerah Labis akan dilencongkan supaya tidak melalui laluan Segamat dan Yong Peng bagi mengelakkannya melalui pekan Labis.
“Mereka yang datang dari Johor Bahru melalui Yong Peng dan Kuala Lumpur melalui Pagoh dan Segamat akan dilencongkan ke Kepong bagi mengelakkan mereka terperangkap dalam kesesakan lalu lintas di pekan Labis," katanya.
Menurutnya, beberapa jalan di Labis juga ditutup bagi mengelakkan kesesakan lalu lintas sepanjang tempoh penamaan calon.
It's BN vs PAS in Tenang

LABIS: The Tenang state by-election on Jan 30 will see a straight fight between Barisan Nasional (BN) and PAS.
BN is represented by former Rengit assistant land administrator Mohd Azahar Ibrahim while PAS is by its Labis Muslimat chief Normala Sudirman, 38, who is also a former teacher.
The contest was announced by Returning Officer Md Asri Amir at the Labis District Council, the nomination centre for the by-election.
The sea of supporters greeted the announcement in thunderous applause, signalling the start of the battle for Tenang.
Mohd Azahar was the first to hand in his nomination papers, at 9.02am followed by Normala at 9.10am.
The nomination process went smoothly despite the presence of thousand of supporters.
The seat fell vacant following the death of its incumbent, Datuk Sulaiman Taha of BN on Dec 17.
Sulaiman defeated PAS' Mohd Saim Siran with a majority of 2,492 votes in the 2008 general election.
This is the 14th by-election after the 2008 polls. This is, however, the first by-election in Johor since the last general election.
Met by reporters, Mohd Azahar said he would work hard get the support of the voters irrespective of their race to ensure victory for the BN.
Asked on his opponent, he said: "Men and women have their own advantage."
Normala said she believed that the Tenang voters wanted to see changes in the area.

mereka tidak ada kad pengenalan....?????Tiada Alamat Rumah.....
